Felony charges have been dismissed against a 25-year-old Eugene man arrested last month on suspicion of possessing two explosive devices.
Two counts of unlawful possession of a destructive device have been dropped against Skylor J Koelzer after Eugene police last month said they found two improvised explosive devices April 7 in a vehicle while on the scene of an investigation near the 2100 block of West 16th Avenue.
“The state of the evidence is such that a material element of the crime cannot be proven beyond a reasonable doubt,” Christopher Parosa, Lane County district attorney, said in a motion filed May 5. Lane County Circuit Judge Amit Kapoor the same day ordered the two counts dismissed.
The court filing did not give additional information about why the explosive device charges were dropped. According to a probation violation report, Koelzer told police he had been aware of the explosive devices for about a month after purchasing the vehicle from a Highway 99 car lot.
A Lane County grand jury April 14 indicted Koelzer on the explosives charges and also misdemeanor unlawful possession of a firearm and methamphetamine charges. The misdemeanor charges remain pending.
