A Eugene Municipal Court judge found that University of Oregon assistant football coach Ra’Shaad Samples is ineligible for DUII diversion.

Municipal Judge Robert Schrank issued the order Oct. 30 after a hearing in which he heard testimony about Samples, 31, backing into the front of a parked vehicle in downtown Eugene early April 12.

Four people in the parked vehicle testified in an Oct. 27 hearing they sustained injuries from the collision.

Under Oregon law, injuries to anyone other than the DUII driver are listed as disqualifying for participation in diversion, a program that allows participants to avoid a criminal conviction.

For the Oct. 27 hearing, defense attorney Bryan Boender brought in an expert in biomechanics, Wilson Hayes, who testified that an analysis of dash-cam video from the parked vehicle showed “the forces on the occupants are extremely small.”

Schrank wrote in his order he considered “the testimony of witnesses, the arguments of counsel, [and] Defendant’s Memorandum of Law,” in addition to other case files.

“The Defendant has failed to prove by a preponderance of the evidence that no physical injury occurred,” Schrank wrote.

Samples, 31, drove away after the collision, but then pulled over about a block and a half later, after being followed by the vehicle he struck, according to video and testimony given Tuesday.

Samples has been a member of the Ducks coaching staff the 2024 season. His next scheduled court date is Dec. 3. Samples has pleaded not guilty to misdemeanor charges of hit-and-run with property damage and reckless driving.
