A Eugene police investigator sought a warrant to perform a mechanical inspection of the car that struck and killed a University of Oregon doctoral student who was riding a bicycle, according to court documents.

Erick Munene Njue, 30, died Jan. 25 after being hit as he headed west on East 22nd Avenue across Patterson Street just before 1:30 p.m., according to search warrant documents filed in Lane County Circuit Court. Njue was an international student from Kenya.

The car that hit Njue had been traveling south on Patterson Street at an estimated 50 mph, 25 mph over the posted speed limit, the court documents state. The documents cite as evidence both witness statements and a dashcam video from a vehicle that was passed by the driver who struck Njue.

The court documents do not include any reference to statements made by the driver.

The Eugene police investigator stated that an inspection could find any possible mechanical problems and, if mechanical failure is ruled out, assist in any criminal prosecution. A judge approved the application for the search warrant.
