Scott Shawn Stolarczyk, the 51-year-old driver of a vehicle that hit and killed Sharon Schuman, pleaded not guilty on Friday afternoon to charges of second-degree manslaughter and driving under the influence.

Bail was set at $175,000 for Stolarczyk, who was booked into Lane County Jail on Thursday, one day after his indictment on the charges. After his brief court hearing Friday, Stolarczyk was released after paying $17,500 — 10% of the bail amount. While released, Stolarczyk must comply with electronic alcohol monitoring.

The charge of second-degree manslaughter is a felony with a maximum sentence of 10 years in prison and a $250,000 fine. Stolarczyk’s charge of driving under the influence is a misdemeanor.

The indictment is in connection with an April 23 collision in which police said a Toyota RAV4 driven by Stolarczyk jumped a curb, striking Schuman as the 79-year-old former University of Oregon literature professor was jogging on the Amazon Trail.

Stolarczyk Friday appeared before Judge Bradley Cascagnette on a remote video link from Lane County Jail, answering “I do, your honor,” when asked if he had received a copy of the indictment.

A woman who told jail staff she is Stolarczyk’s wife stood in a nearly empty observation room at the jail, watching the proceedings on a monitor. She declined to comment, as did Andrew Kraushaar, the attorney representing Stolarczyk in the hearing.

“I’m not going to talk with you,” Kraushaar said after the hearing.

Bail conditions are set by Pre-Trial Services under the authority of Lane County Circuit Court.

An affidavit of probable cause filed in Lane County Circuit Court states that Stolarczyk’s ethanol level was 0.234% at 10:26 a.m., about 41 minutes after the vehicle he was driving struck and killed Schuman in the 2500 block of Amazon Parkway.

Her daughter, Rebecca Schuman, in a brief statement Friday, said: “All of us remain devastated at the loss of my mother and we are committed to the pursuit of justice.”

Stolarczyk was taken to a hospital after the crash, and Eugene police later obtained a warrant for the hospital blood draw. A state police lab determined the blood alcohol concentration to be 0.196%, more than double the legal limit of 0.08%, according to court documents.

His next court appearance is scheduled for July 10.
