The driver charged Jan. 8 with failing to stop after striking a bicyclist on Highway 99 had been cited four months earlier with driving under the influence of intoxicants.
Kacy Daniel Foster, 36, is alleged to have failed to perform duties as a driver to injured persons, a Class B felony. Merle Dean Sheffield, 63, died days after being struck by a vehicle Jan. 3.
Prosecutors Thursday, Jan. 22, filed a notice alleging aggravating circumstances given Foster’s separate and still pending criminal case, as well as his being suspected of driving with a suspended license.
If Foster is convicted, his sentence could be revised upward from sentencing guidelines because of the alleged aggravating circumstances.
Springfield Municipal Court records show that Foster pleaded not guilty after being cited Aug. 1 with driving under the influence of intoxicants, operating a vehicle without driving privileges and refusing a breathalyzer test. He has a municipal court appearance scheduled for Feb. 2.
Eugene Municipal Court records show Foster with an active arrest warrant issued Jan. 6 in connection with a pending charge of driving while having a suspended license.
Municipal court records show numerous driving-related citations for Foster over several years.
Most recently, he was found guilty by default last week in Eugene’s court for driving without insurance and failing to register a vehicle. In Springfield, Foster last February pleaded no contest to driving while using a cell phone and operating a vehicle without driving privileges.
Foster has been released on electronic monitoring, court records show. His next court appearance on the felony charge is set for Feb. 12 in Lane County Circuit Court.
