A Lane County jury Wednesday, Jan. 7, found James Allen Thomson guilty of fleeing police in a Nov. 14 pursuit that Eugene police said left three police vehicles damaged and an officer injured.
In addition to fleeing, a felony, the jury found Thomson, 46, guilty of misdemeanor recklessly endangering and misdemeanor reckless driving.
The pursuit of a Ford F-150 driven by Thomson began at about 3:05 p.m. near Valley River Center and took place amid heavy game-day traffic a few hours before kickoff of a University of Oregon football game at Autzen Stadium, police have said.
Police obtained blood samples from Thomson, whom they suspected of driving under the influence of illicit substances, and a grand jury indicted him on a driving under the influence charge.
But court records include a judge’s order dismissing the driving under the influence charge Jan. 6 because the “state of the evidence is such that a material element of the crime cannot be proven beyond reasonable doubt.” The dismissal came after a motion from prosecutors, according to the court order.
Judge Tracy Prall, typically a Marion County Circuit Court judge, on Jan. 15 sentenced Thomson to 18 months of supervised probation, along with 90 days in jail. Thomson received credit for time served. Prall also sentenced Thomson to 24 months of bench probation, with the sentences to run concurrently.
A charge of fourth-degree assault was also dismissed Jan. 15 “in the interest of justice,” a court order stated. Court records show the jury did not convict Thomson on the assault charge.
